General Terms and Conditions Malvales Resort

1. Applicability
   1.1 These General Terms and Conditions apply to all agreements and bookings between Malvales Resort (hereinafter “the resort”) and the guests (hereinafter “the guests”) who use the facilities and services of the resort.
   1.2 By using the resort and making a reservation, guests agree to these General Terms and Conditions.
2. Reservations and payments
   2.1 Reservations can be made via the website, by e-mail or by telephone. The resort reserves the right to refuse reservations without stating reasons.
   2.2 When making a reservation, a deposit is required. The remaining amount must be paid upon arrival or according to the payment terms agreed between the resort and the guests.
   2.3 All prices include taxes and other levies, unless stated otherwise.
3. Cancellations and changes
   3.1 Cancellations must be reported in writing to the resort. The cancellation policy may vary per reservation and will be stated in the confirmation email or on the resort’s website.
   3.2 In case of cancellation, cancellation costs may be charged. The resort reserves the right to charge these fees based on the time of cancellation and length of stay.
   3.3 Changes to a reservation are subject to availability and may incur additional charges.
4. Check-in and check-out
   4.1 Guests can check-in at the resort’s stated check-in time. If guests expect to arrive later, they must inform the resort.
   4.2 Check-out must take place at the stated check-out time of the resort, unless otherwise agreed. Failure to adhere to the check-out time may result in additional charges.
5. Responsibility of the guests
   5.1 Guests must handle the holiday homes and the resort facilities with care. Any damage caused by guests must be reported immediately to the resort and reimbursed according to the established prices.
   5.2 The resort is not responsible for any personal belongings of guests lost or damaged during their stay.
   5.3 Guests must adhere to the house rules and follow any instructions from the resort staff.
6. Liability
   6.1 The resort is not liable for any form of injury, loss, theft, damage or inconvenience caused during the guests’ stay.
   6.2 The resort is not liable for any service disruptions that are beyond the resort’s control, such as natural disasters, strikes, technical failures, etc.
7. Privacy and data protection
   7.1 The resort will only use guest personal information in accordance with the resort’s privacy policy.
   7.2 The resort will not provide personal data to third parties unless this is necessary for the execution of the agreement or if required by law.
8. Disputes
   8.1 Dutch law applies to these General Terms and Conditions and all agreements between the resort and the guests.
   8.2 Disputes arising from these General Terms and Conditions will initially be submitted to the competent court in the district where the resort is located.
9. Other provisions
   9.1 If any provision of these General Terms and Conditions is declared void or invalid, the other provisions will remain in full force and effect.
   9.2 The resort reserves the right to change these Terms and Conditions at any time. The changed conditions apply to all new reservations after the change date.
